GENERAL TERMS AND CONDITIONS (GTC)

1. Scope
These terms and conditions apply to all orders placed via www.emilianos-design.ch.
Sales are made to Switzerland and member states of the European Union.
2. Contracting parties

3. Conclusion of contract
The presentation of the products does not constitute a legally binding offer.
By completing the order process, the customer submits a binding offer.
The contract is concluded upon confirmation of shipment or delivery.
4. Prices and Payment Terms
All prices are quoted in CHF.
Shipping costs are shown separately.
Payment is made using the payment methods offered in the shop.
5. Production principle (print-on-demand)
All products are individually manufactured after ordering.
Production begins after payment is received.
6. Delivery conditions
The separately listed shipping and delivery conditions apply.
7. Retention of title
The goods remain the property of Emiliano's Design until full payment is received.
8. Warranty
The statutory warranty rights of the respective country of delivery apply.
In the case of justified defects, a replacement delivery or refund will be provided.
9. Limitation of Liability
Liability is limited – to the extent permitted by law – to intent and gross negligence.
Mandatory consumer protection rights remain unaffected.
10. Applicable Law
Swiss law applies.
For consumers within the EU, mandatory provisions of the country of residence remain unaffected.
11. Place of jurisdiction
The place of jurisdiction is the registered office of Emiliano's Design, unless mandatory consumer protection regulations stipulate otherwise.

SHIPPING AND DELIVERY TERMS
==============================
1. Production time
2–5 working days after receipt of payment.
2. Delivery time
Switzerland: Production time + 2–7 working days.
EU: Production time + 3–10 working days.
3. Partial deliveries
Orders can be shipped in multiple shipments.
4. Customs and import duties
Customs duties or import taxes may apply to deliveries within the EU.
The buyer bears this cost.
5. Transfer of Risk
For consumers, the risk passes to them upon delivery of the goods.
For entrepreneurs handing over the goods to the transport company.
6. Undeliverable items
In case of incorrect address or failure to collect, the customer bears the costs of redelivery.
7. Force Majeure
We accept no liability for delivery delays caused by force majeure.

CANCELLATION POLICY
==============================
Right of withdrawal for consumers (EU)
You have the right to withdraw from this contract within 14 days without giving any reason.
The deadline is 14 days from the day on which you or a third party designated by you received the goods.
To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement (e.g. by e-mail).
Consequences of the revocation:
In the event of a valid cancellation, we will refund all payments received, including delivery costs (excluding additional costs for special shipping methods), within 14 days.
Exclusion of the right of withdrawal:
The right of withdrawal does not apply to contracts for the supply of goods,
- which are not prefabricated and for whose production an individual selection or specification by the consumer is decisive,
- or those that are clearly tailored to the personal needs of the consumer (print-on-demand products).
